Bringing Union Representation to Investigatory or Disciplinary Meetings

Employees covered by a collective bargaining agreement have the right to request union representation where there is reasonable belief that discipline, or adverse consequences could result from the meeting.  These rights are called Weingarten rights and attach when investigatory interviews (formal and informal) are conducted.   Weingarten rights do not apply for non-investigatory meetings or for meetings where the discipline is being issued.  If representation is requested and the Weingarten rights apply, the meeting should be paused or rescheduled to allow the union representative to attend.
